ClaimLayer - Terms of Service

Welcome to ClaimLayer. These Terms of Service ("Terms") govern your access to and use of the ClaimLayer website and services.

By accessing or using ClaimLayer, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Description of Service

ClaimLayer is a software-as-a-service platform that provides an interactive map and data tools designed for United States prospectors and mining claim researchers.

The platform aggregates and visualizes mining claim and geographic information from various public and third-party sources.

Access to ClaimLayer is provided through an online map interface at ClaimLayer.com.

2. Acceptable Use

Users agree to use ClaimLayer only for lawful purposes. Prohibited activities include:

Access to ClaimLayer is permitted only through the official web interface. API access and automated scraping are not permitted.

3. Accounts

Users may be required to create an account to access certain features.

Account credentials may not be shared between users. ClaimLayer reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription Billing

Certain features of ClaimLayer require a paid subscription.

Subscriptions are billed monthly on a rolling billing cycle beginning on the date of subscription.

By subscribing, you authorize recurring monthly billing using your selected payment method.

Subscription pricing may change in the future. If pricing increases, ClaimLayer will provide advance notice via email before the change takes effect.

Users may cancel their subscription at any time. Access will remain active until the end of the current billing period.

5. Refunds

Subscription payments are generally non-refundable.

In the event of a significant or extended service outage, ClaimLayer may provide prorated refunds at its discretion.

6. Service Availability

ClaimLayer strives to maintain reliable service, but uptime is not guaranteed.

The service may experience interruptions due to maintenance, updates, infrastructure issues, or factors beyond our control.

ClaimLayer is not responsible for any losses resulting from service interruptions.

7. Data Sources and Accuracy

ClaimLayer aggregates mining claim and geographic data from government agencies and other third-party sources.

While reasonable efforts are made to maintain accurate and up-to-date information, ClaimLayer does not guarantee the completeness, accuracy, or timeliness of any data displayed on the platform.

Users should independently verify mining claim information using official government records before making decisions based on ClaimLayer data.

Mining claim status should always be verified through official government records before taking action in the field.

8. Intellectual Property

The ClaimLayer platform, including its proprietary software, map interface design, and any datasets compiled or created by ClaimLayer, is the property of ClaimLayer and is protected by applicable intellectual property laws. Third-party libraries, APIs, and services are not owned by ClaimLayer and are subject to their respective licenses.

9. Data Extraction and Dataset Protection

Users may not systematically extract, download, copy, or reproduce substantial portions of ClaimLayer data.

Use of ClaimLayer is permitted solely through the official web interface. Any attempt to collect ClaimLayer data outside normal interactive use may result in immediate account suspension or termination.

10. Field Use and Safety Disclaimer

ClaimLayer provides mapping and informational tools intended to assist users in researching mining claims and geographic information.

Use of ClaimLayer for planning trips, navigating outdoor areas, or traveling in remote or hazardous terrain is undertaken entirely at the user's own risk.

ClaimLayer does not guarantee that map data, land boundaries, terrain information, or mining claim data are accurate, complete, or suitable for navigation or safety decisions.

Users are solely responsible for:

ClaimLayer shall not be responsible for any injury, loss, property damage, or other harm resulting from reliance on the platform when planning trips or while in the field.

11. Account Suspension and Termination

ClaimLayer reserves the right to suspend or terminate accounts that violate these Terms or engage in behavior that harms the service or other users.

In cases involving abuse, fraud, scraping, credential sharing, or attempts to circumvent service protections, ClaimLayer may suspend or terminate access immediately and without refund.

12. Dispute Resolution and Class Action Waiver

Any disputes arising from or relating to the use of ClaimLayer shall be resolved on an individual basis.

To the fullest extent permitted by law, users agree that any dispute or claim against ClaimLayer must be brought individually and not as part of a class action, collective action, or representative proceeding.

Users waive the right to participate in any class action lawsuit or class-wide arbitration against ClaimLayer.

13. Land Access and Trespass Disclaimer

ClaimLayer provides mapping information for research and informational purposes only.

Users are solely responsible for ensuring that any entry onto land, including mining claims, private property, or restricted areas, is legal and authorized.

ClaimLayer does not grant any rights to enter private or restricted land and shall not be liable for any damages, fines, injuries, or legal consequences resulting from a user’s access to such areas.

14. Disclaimer of Warranties

ClaimLayer is provided on an "as-is" and "as-available" basis.

No warranties, express or implied, are made regarding the reliability, accuracy, or availability of the service.

15. Limitation of Liability

To the maximum extent permitted by law, ClaimLayer shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use the service, including losses resulting from reliance on data provided by the platform.

16. Changes to the Service

ClaimLayer reserves the right to modify, suspend, or discontinue any part of the service at any time without notice.

17. Changes to Terms

ClaimLayer may update these Terms from time to time.

Continued use of the service after updates are posted constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict of law principles.
